Family Fitness – Website Terms & Conditions

Welcome to the Family Fitness website. By accessing or using this website and/or signing up for any Family Fitness services, memberships, promotions, classes, or facilities, you agree to be bound by the following Terms and Conditions.

These Terms and Conditions should be read together with your Membership Agreement, Application Form, Debit Order Authority, Privacy Policy, and any rules displayed within Family Fitness facilities.

1. Definitions

In these Terms and Conditions:

  • “Family Fitness” / “the Gym” / “we” / “our” / “us” refers to Family Fitness (Pty) Ltd.
  • “Member” / “you” / “your” refers to any person applying for, purchasing, or using a Family Fitness membership or facilities.
  • “Membership Agreement” refers to the signed or electronically accepted agreement between Family Fitness and the Member.
  • “Facilities” refers to all gym equipment, training areas, parking areas, studios, classes, crèche facilities, and any related services offered by Family Fitness.
  • “Website” refers to the official Family Fitness website and all related online platforms.

2. Membership Eligibility

2.1 Membership is available only to persons who:

  • Are 13 years or older;
  • Provide valid identification documentation; and
  • Agree to these Terms and Conditions.

2.2 Members under the age of 18 must be assisted by a parent or legal guardian when entering into a membership agreement.

2.3 Memberships entered into by children under the age of 13 are void.

2.4 Family Fitness reserves the right to refuse or cancel membership applications at its sole discretion.

3. Membership Fees & Payments

3.1 Membership fees, joining fees, administration fees, levies, and other charges are payable as agreed in the Membership Agreement.

3.2 Members paying monthly must do so via debit order unless otherwise agreed in writing.

3.3 Pro-rata payments made upon joining cover only the remaining days of the joining month and do not form part of the fixed membership term.

3.4 Membership contracts commence on the first day of the following calendar month after the pro-rata period.

3.5 Membership fees are subject to annual increases and may also be adjusted due to operational cost increases, including but not limited to utility increases, taxes, fuel increases, import costs, or government-imposed charges.

3.6 Family Fitness reserves the right to:

  • Re-submit rejected debit orders;
  • Debit accounts on the next working day should the payment date fall on a weekend or public holiday;
  • Charge administration fees and bank charges for rejected or late payments.

3.7 Certain memberships may be subject to additional annual levies or seasonal charges as communicated in the Membership Agreement.

3.8 Failure to make payment may result in:

  • Suspension of access;
  • Cancellation of membership;
  • Handing over the account for debt collection; and/or
  • Legal action.

4. Membership Renewals & Cancellations

4.1 Fixed-term memberships remain active for the full agreed term.

4.2 Early cancellation of a fixed-term membership may result in a cancellation fee.

4.3 Cancellation requests must be submitted via email to the official Family Fitness cancellation email address.

4.4 A cancellation is only valid once confirmed in writing by Family Fitness.

4.5 Auto-renew memberships will automatically renew unless cancellation notice is received at least one calendar month prior to renewal.

4.6 Memberships are non-transferable and may not be ceded to another person.

4.7 Family Fitness reserves the right to place cancelled or defaulting memberships on a waiting list.

5. Use of Facilities

5.1 Members use all Family Fitness facilities entirely at their own risk.

5.2 Members agree to:

  • Use equipment responsibly;
  • Follow all gym rules and staff instructions;
  • Wear appropriate training attire and footwear;
  • Return weights and equipment after use;
  • Respect other members and staff.

5.3 Members may not:

  • Allow non-members access using their membership details;
  • Damage or misuse equipment;
  • Engage in disruptive, dangerous, or abusive behaviour;
  • Conduct personal training services without written approval from Family Fitness;
  • Use recording devices in a manner that invades another member’s privacy.

5.4 Family Fitness reserves the right to suspend or terminate memberships for misconduct, rule violations, abusive behaviour, or misuse of facilities.

6. Health & Medical Conditions

6.1 Members confirm that they are physically and medically fit to participate in exercise and gym-related activities.

6.2 Members with any medical condition, injury, illness, or health concern should consult a medical professional before participating in physical activity.

6.3 By using the facilities, Members acknowledge and accept all risks associated with exercise and training.

7. Personal Trainers

7.1 Independent personal trainers operating within Family Fitness are not employees of Family Fitness unless specifically stated otherwise.

7.2 Any agreement between a Member and a personal trainer is solely between those parties.

7.3 Family Fitness accepts no liability for services rendered by independent personal trainers.

8. Children & Crèche Facilities

8.1 Children may only access designated child-minding or crèche areas where applicable.

8.2 Members remain fully responsible for their children while on Family Fitness premises.

8.3 Children are not permitted to use gym equipment unless specifically authorised.

8.4 Any damage caused by children to equipment or facilities may be charged to the responsible Member.

9. Parking

9.1 Parking is provided entirely at the Member’s own risk.

9.2 Family Fitness is not responsible for:

  • Theft of vehicles or contents;
  • Damage to vehicles;
  • Losses incurred while using parking facilities.

9.3 Parking restrictions and penalties may apply.

10. Photography & Media

10.1 Family Fitness reserves the right to photograph or video record within its facilities for marketing, promotional, security, or operational purposes.

10.2 Members who appear in promotional content without objection grant Family Fitness permission to use such content for marketing purposes.

10.3 Members may not record or publish content containing other members without their consent.

11. Limitation of Liability & Indemnity

11.1 To the fullest extent permitted by law, Family Fitness shall not be liable for:

  • Any injury, illness, death, loss, or damage suffered while using the facilities;
  • Theft or loss of personal belongings;
  • Interruptions to services caused by circumstances beyond its reasonable control.

11.2 Members indemnify and hold harmless Family Fitness, its owners, employees, contractors, and representatives against any claims arising from:

  • Use of the facilities;
  • Participation in activities;
  • Breach of these Terms and Conditions.

11.3 Members acknowledge that exercise and physical activity carry inherent risks.

12. Website Use

12.1 The content on this website is provided for general information purposes only.

12.2 Family Fitness makes reasonable efforts to ensure information is accurate but does not guarantee completeness or accuracy at all times.

12.3 Members may not:

  • Misuse the website;
  • Attempt unauthorised access;
  • Upload malicious software;
  • Copy or distribute website content without written permission.

12.4 Family Fitness reserves the right to update website content, pricing, promotions, and policies at any time without prior notice.

13. Privacy & Communication

13.1 By providing your personal information, you consent to Family Fitness communicating with you regarding:

  • Membership matters;
  • Promotions and events;
  • Facility updates;
  • Administrative notices.

13.2 Family Fitness may conduct credit checks where permitted by law.

13.3 Personal information will be processed in accordance with applicable South African privacy legislation.

14. Relocation of Facilities

14.1 Family Fitness reserves the right to relocate facilities within the operational area if necessary.

14.2 Should relocation result in revised membership pricing or fees, Members will be notified accordingly.

15. Force Majeure

Family Fitness shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to:

  • Utility interruptions;
  • Natural disasters;
  • Government actions;
  • Epidemics or pandemics;
  • Civil unrest;
  • Strikes;
  • Fire or flooding.

16. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes arising from these Terms and Conditions shall be subject to the jurisdiction of the South African courts.

17. Amendments

Family Fitness reserves the right to amend these Terms and Conditions at any time.

Updated versions will be published on the website and will take effect immediately upon publication unless otherwise stated.
